Is it true that teens,who are both underage,having consentual sex is a jailable odffense?Its kind of a contradiction of two people raping each other. How is that possible?With teens having sex now of days,would that basically criminalise more than half the teen population?

no, that would just be a major social problem caused by lack of parenting; clueless children out making babies, and ruining their lives before they even have a chance to live.

No, its "not illegal" for a minor to have sex under the age of 16... But, if some one over the age of 18 has sex with a minor under the age of 16, then its totally illegal as that person, who is an adult is being a pediphile and can be sent to jail for statuatory rape, (5-15 years in most cases). Be as it may, if a minor has a child, then either the parents take care of it, or, the State steps in and has it adopted out, if the minor is unable to provide for the care of it. A baby should 'never' be considered 'punishment' to anyone! Its a gift from the LORD! To be cherrished and loved... I wish you well.. Jesse

Depends on the state. In some states being underage does not protect you from prosecution from having sex with another person that is under age. There is two issues:
1. It makes it illegal for someone that is just below the age of consent from having sex with toddlers.
2. Even if the kids are both the same age, neither has the ability to give informed consent.

The age of consent laws are not about rape as most people think of rape, a forced sexual encounter. These laws protect people that are not able to give informed consent.

Actually, in a handful a state the consenting age for sex is 16. The lowest age is 14, anything lower than that is illegal.

Here are a list of states where it is illegal for two consenting teens to have sex before the age of 16-17:

Yes, it is illegal, for underage kids to have sex... All states have their own minimum age to have sex, most are 16. Not sure what the penalty for this is, but it is a law.

No, just the ones that have parents that don't give a damn about their kids.

szmanhatten - You might want to read those laws a little better next time around. The older of the two will take the heat for it.

its only illegal if the underage teen is sleeping with an adult. they can go to jail for that. the law also is diff. in many states, so check out what your laws are by googleing a site to find info.

oh, and the adult goes to jail, not the teen (i think)

if you are a minor, by, law you can not have consensual sex as a minors decisions is not considered to be legal in sex or making of legal contracts, it the other person in not a minor the can be charged with statuary rape!

It's illegal in Oregon, though never really enforced. It may be illegal in other states as well but you'd have to check.
