verbal and historical terms and conditions are not being recognised by my new employer

Without the specifics it is hard to give a definitive answer, however barring a contract the employer does not have to recognize your terms and conditions.

You will have no rights with verbal agreements with your previous employer, as for historical terms (?) certainly need more information.

Normally under the TUPE law you will only be covered by the written contract which you had with your previous employer......why should any new employer continue with any other conditions not laid out in your contract?

I would also be very careful about what fuss you create - although TUPE law is there to protect you there is a way for your new employer to dispose of you which is quite legal!!

Basically, if the ownership of a business is transferred under the TUPE regs, an employee's terms and conditions are protected.

you need to have a copy of the rights of your job (meaning paperwork) with you as if this employer is not following them you can (then) take them to a lawyer and sue the employer

as by law (if they are in a contract) he is supposed to follow them
