My dad made some stupid business moves and owes people money, well my old man hit the street and now these people want their money. Obviously we don't have it and need to know if there is any legal way that I can have them stop harrassing us? My old man never signed any contracts or is there proof of anything, it was all verbal. Should I go to the police and give them the story. Maybe get a restraint order? I haven't done it because I dont want a full on investigation and have my family now under legal issues, since I dont know any details of anything. thanks.

i would talk to your old man and get ALL of the info b4 you try to do anything with the police.. their may be somethings that he doesnt' want them to know.. not saying that he's doing things that are illegal, but ya know ppl cut corners sometimes, it's cool lol... but like i said i would talk with him and let him know that you are trying to get something done about this and tell him you need to know it all b4 you run and tell someone about something you really have no idea about. but after that's done and everything is clear i would go to the police and file a restraining order first and see how well that works(some ppl don't listen to those)and if that doesn't work try to get some legal advice... if you're down on money and can't afford an attorney. .try to contact your local legal aid office.. < they got my divorce for free!!

You kind of make it sound like a sketchy business. If it is then yeah I would go to the police. If it's not then I would consult a lawyer. A verbal contract is not binding. That's why you always have a lawyer draw up a contract when dealing with anything worth over $500. If they can prove any contracts then it depends on what kind of liability your father had on his business. If he didn't have certain kinds of coverage then he could be held responsible and anything that's in his name can be seized as collateral. Like I said earlier though, If you think the people my hurt you or your family then go to the police immediately otherwise consult a lawyer soon. You shouldn't have to pay for your fathers mistakes and he's obviously not going to be able to straiten it out himself. Good luck.

Relatives are not legally responsible for debts increwed by others in the family. Spouses normally are but kids and others arent unless they are the Power of Attorney. I would get a lawyer or seek the council of legal aide.

THAT is why they created lawyers! Your dad needs to pay the money back. If the people are REALLY bad people, he won't be around long, then the rest of the family will either pay his debts or enjoy the cement overshoes too! People that do what your dad did do not get away with it. No attornery or cop can protect him or you 24/7. The 'loanshark. WILL get his money!

you should see a lawyer. Try for one who does first visit free or apply for legal aid.

The debt is your fathers , they need to approach him about it , but if he has left, they can try to collect any assets he owns . If it was only verbal then ask them to stop calling you, tell them you know nothing about it and go talk to the police about the situation.

if there are no contracts, you have no obligation to any of those people. They are angry that he screwed them out of money, but they need to find him (unlikely) so they come to the family hoping to recover their losses. You have NO legal obligation here. Police are unlikely to be able to help you. Best bet is to speak to an attorney, or move away from there.

Don't acknowledge the debt.

Simply inform "these people" that the debtor no longer lives at your address, that you have no forwarding address for him, and that you desire no further phone calls from them.

If these are loan sharks, I would chat with the police immediately for your own safety.

your dad needs to be doing this, not you.
He could try to declare bankruptcy once he gives up all the money he has...that will clear him from his debts.
