My son was arrested on 3 felony counts of sexual assault on a child. This people started everything on some text messages on a cell phone he had and they found on her daughter of 15 years of age. Text messages were not meant for her, but her father insisted they were, he came after my son with a vengeance and found a girl to lie about her and my son having sex 3 times. This father has been to my sons ex girlfriends and tried to get them to say negative things about him and they want to know who else he has been out with so they can get them to testify against my son. Now he has that charge and people here in our community are so ugly about it. He works for EMS and they had a presentation at the school and the principal there told him to leave the premises. He did not want him there, so my son left. Can they do that? He has not been convicted or indicted only arrested on this. What are my rights as far as coming back after these people? Thanks in advance.

Principal had the right to ask him to leave. If your son is suspected and the principal let him stay. alot of parents would of called to protest and it would of been a big ugly mess. Your son did the right thing by leaving even if he did nothing wrong. In certain small towns people hold big grudges on a person and will do ugly things if they think the person is guilty. I would say it's time to see if your son can get a fresh start somewhere else with the courts permission. If he stays out of trouble there then you know you have a good son. If he seems to have the same problems there, then unfortuately maybe those who thought him guilty were correct.

It's up to a court to convict or acquit your son. It is not up to the girls father or you. There is nothing wrong with the father looking for further witnesses or victims. In the end it is unlikely the father will get anyone to lie for him under oath. If your son has a good lawyer they can usually torpedo fake testimony.

I'm not really going to address the text messages, however test messages are not often mis-routed, particularly 3 times.

Yes, the school has a duty to exclude a person that has been charged with a sexually related offense from the school grounds. In the case of a school employee they are normally place on admin leave while the charges are pending.

What are your rights? - None. You are not legally involved.

Not the answer you'll want to hear, but isn't your son old enough to fight his battles? You want to know YOUR rights in this, but you have no rights, they belong to your son.

I am the one who gave you advice on another question regarding this same case. I understand that you want to help your son, but since he's not currently in jail, he needs to fight this himself with your support.

Your son will have his day in court, get him a good lawyer
