The answer to this question depends on the telling of Superman's origin. I the early tellings the Kents to him to an orphanage and came back and then adopted him. In later tellings they take him straight home. Smallville plays on the later by adding the Luthor family to the mix.

Originally, they first took him to an orphanage and then Martha felt compelled to go back. Current version of the story says that took him home and after a long winter story they told people that she had had Clark at home and were unable to get to the hospital or contact a doctor.

The original story had Martha taking the child to the farm immediately. Jonathon felt guilty about it and tried to contact the media to see if the child's real parents could be found. Recalling where the child was found Jonathon had a change of heart and filed all the papers for adoption through a law firm funded by Lionel Luthor.
