She has a right to see the child. She is her daughter too. But I'm not so sure about taking her to another country. You should consult an attorney and see what your rights are in regards to that.

No judge would let your wife remove your daughter from the states (I'm just assuming that is where you reside) especially if your daughter is already oriented here. I had just seen a case like this recently in court where the wife decided upon agreement of a seperation from her husband that she needed to move back home to Israel and the husband would remain here. The wife went in to court weeping and begging and the judge told her over and over that it was her decision to move back to Israel, the son was already established here, and that she could have visitation two weeks every three months to visit. The judge also stipulated that the mother could speak to her son every evening at 7 o clock pm and the child would have to be available unless otherwise scheduled. I felt bad for her watching all this unfold, but it WAS her fault. I don't see why you couldn't do the same thing, after all, it's your wife's decision to pick up and leave, not yours and your daughters. You should fight it.

If you really want your dayghter to stay with you, you'll have to take your wife to court. You'll have to prove you can give your daughter a more stable life with you and that going with you wife would not be the est thing for her. Maybe bring up the fact that your daughter has family and community ties where you live now. Is your wife's Family going to be where she is moving? Does your daughter go to school? You should point these things out. You'll really have alot of work to do to prove your daughter is best with you but if you really want her to stay with you then you should atleast give it a try. You need to go to an excellent family/custody lawyer and retain them. File papers so that your wife cannot leave the state, let alone the country with your daughter. Protect your rights. Do not think this will go away or change. Once she leaves you probably will never see them again. Go file for full custody of the child NOW!!!!!!! Do not take a chance. Good luck

You have to petition her in court and file for custody, that way a judge will tell her she can not leave the State/Country without approval and if she does she would be facing kidnapping charges!!! So go to a lawyer or to the court house so that you can get the ball rolling before she leaves w/o that you have no choice but to beleive she will come back..as long as you have court order you will be ok...

If you are the custodial parent now, and you want to remain a custodial parent in this country, you need to act now to get a divorce from your wife and obtain sole custody of your daughter, otherwise, your wife can just take her the next time she comes to visit and you won't be able to legally stop her.
Get yourself a lawyer.

The easy solution is to wait until she is out of the country. Then go to court and claim that she abandoned her and that you don't know where she is. Then you will get full custody of your daughter and not have to worry about anything, because you will have all the say in what goes on with your daughter.

Poor little angel.....Feel sorry for her.....she should not be denied the love of both the parent....Work a way out...Either you too emigrate or let your wife stay back....Why should a child suffer coz. of different aspirations of parents....So, Mr. & Mrs Parent work it out....This precious little time of formative years wont come back for her...Everything else can be arranged according to the situation..Dont haste to regret later on...

go to the family court NOW and ask a judge to order her not to leave the country, but do it now. You may be able to get an Emergency Hearing, but If I were you I'd hire a lawyer to do it. Because once she's gone she doesn't have to come back.

I think that your so called wife chose what is more important to her.Clearly not her Daughter!! You Need to take this to court as she abandon you BOTH!! You are doing great with surrounding her with Family. God Bless All Daddy's Like YOU!!!
