depends on the state you live in, but in New york State you have to be 18 to legally enter into any contract

I got a cellphone contract when I was 18, and I had to put down a $150 deposit because I had no credit. So if you're going to get a contract by yourself, I recommend either having a small credit card to build up your credit beforehand (this'll help you with a lot of other things in the future too) or shelling out the deposit. You get the deposit credited to your account after a year.
If you're in your teens and such, I would recommend going prepaid or getting in a family plan with your parents. Plans are good if you talk a LOT on the phone, but if you don't talk a lot and just need it for people to get ahold of you... then I'd go prepaid.

As with any contract in the united states you have to reach the age of majority. Usually 18, some states 19 some states 17.
You can get a pre-paid plan though. (US Cellular has really good deals on pre-paid plans)
