You're talking about two different things.

One is the effect on the victim -- which arguably is no different than if the perpetrator was 14 or 44. That's something that she is going to have to deal with regardless of what happens to the person who touched her.

The other is what should be done to the defendant -- and in every society, children are treated differently in the criminal justice system than adults. In the US -- 14 is too young to be tried as an adult -- meaning that at most, he will be sentenced to 4 years in juvenile detention -- at most.

But whether he's sentenced to 4 days or 4 years or 40 years -- it doesn't change what happened to the victim -- and she has to come to terms with that on her own, with help.

I think an apology should be acceptable. If there was violence or intimidation involved then he should be closely supervised for a significate period until any underlying problem is resolved.

Children should be treated like children not adults. They have trouble sorting out conflicting messages and should be given a second chance where possible.

On a wider point a don't like the term sexual assualt when there is no violence or threat of violence involved. Sexual abuse or molestation is bettter perhaps.

We all carry the results of every action for the rest of our lives.

There are plenty children with ruined lives over consensual sex, forever branded as child predators. Doing so dilutes the impact on REAL predators, who at 50 would still attack a 12 year old!

There should be consequences for stupidity, and public humiliation at the time might serve both as punishment and an educational tale to others. Severe punishment that engenders hate toward all women and the desire to take revenge is of course quite counter productive.

Likewise understanding and counseling for the girl is necessary for the same reason.

Honestly, I think if she is ok with it that its more than fair. We are talking about children here, even though they are 12 and 14.

Their mental reasoning capabilities are woefully underdeveloped. Public humiliation would be sufficient here, possibly an apology in public at their school or home?

It would be best to think of it as just something that happened. Don't make a big deal out of it.
Boys are curious about girls.
Would you want to change that?
