Depends on the jurisdiction (state) that you live in. I believe that most states regulate this practice. Look at your state's website for links to regulations and codes.

Each state has a website that you can visit -- either the general legislative information (the statutes and laws of the state) and/or the Department of Health and Safety (or whatever it's called in your state) that handles licensure.
So, to know which website to send you to -- you'd have to tell us which state you're in.
