I know I just asked a question about this an hourish ago, but the asnwers make it seem like we work in a huge company or something, but we are only 15 so there is no company to complain to because it was a volunteer job. Anyways, one of my friends was in an uncomfortable situation for 4 months and we feel like it was sexual harassment. He was atleast 40 years old and he was hitting on a 14 y/o. He made jokes about removing her clothing and using corporal punishment (the belt, spanking) becuase she made afew harmless errors. Before we take action we were wondering if by law this would be sexual harassment?

Yes............. But sexual harassment is NOT a criminal offense.

Sexual harassment is covered by EEOC rules. One can be fired and the company can not be held liable for it if they are. A person can file a civil law suit against a person for sexual harassment or against a company if they allow it to go on once notified. The police DO NOT investigate sexual harassment.

That said........... If a 14 year old girl is involved, then other laws apply. If all this clown is doing is talking dirty to her... it is not a crime, although it is disgusting. The company MUST take corrective action or they can be held liable. And if this guy were to in fact "touch" this girl in any sexual manner, then that could be Sexual Battery..... And that is a crime.

And if he does do anything to her... he is going to get arrested and the company could and would be held liable when her parents sued!

I see huge $$$ in this girls future if some one does not stop this.

I DO NOT CARE IF THERE WERE 5 EMPLOYEES OR ONE PERSON AND THE BOSS.

SEXUAL HARASSMENT IS SEXUAL HARASSMENT. AS A VOLUNTEER YOU HAD TO BE PLACED BY?
APPLIED TO BE CONSIDERED?

14 YEARS OLD IS ALSO CARDINAL KNOWLEDGE IN SOME STATES OR SOLICITATION OF A MINOR UNDER 17.

TALK TO EEOC IT IS A VIOLATION NO MATTER WHAT LEVEL AND IF NO PROCEDURES ARE IN PLACE, THEY SOON WILL BE.

ALTHOUGH HE MAY BE MAKING FUN, HIS FUN IS BORDERING ON BEING A PEDOPHILE BY THE WAY YOU TALK. NEEDS TO BE CHECKED OUT. MAYBE WHY HE HIRES TEMPORARY HELP.
