I live in maryland, a state which has a ban on magazines for rifles that hold more than 20 rounds. What is allowed is if i leave the state and purhase them where they are legal. My sister lives in a high-cap legal state and has bought two of them for me. my father is going to her state tomorrow to see her.

heres the thing. I am 16, the rifle i own is in my fathers name, but he doesnt shoot it. if he is across the state line in the high-cap legal state and recieves the magazine from my sister may i have them when he gets back? or at least "use them" as i do "his" rifle? or would I physically have to recieve them in the hi-cap legal state.

sorry i know this is a confusing question

JD, i thought that it was fine for me to legally own a high capacity magazine in maryland as long as it was purchased and transfered in a state that permitted it?

Your question is NOT confusing..As a Dealer myself here in Maryland we are banned from buying,possessing or shipping extended capacity magazines under Maryland law. There is no way around it. Get caught and they will get confiscate your magazines, along with your firearm regardless of who's name it's in......Sorry

first, at 16 you cannot own a long gun, you must be 18, (21 for a handgun) second, no it is not legal to bring those high capacity mags back to Maryland. It violates state law.
Remember too, that if you violate the law, get caught and convicted, you can never own a firearm again. Also, your father could, and probably would face charges for supplying you with the rifle, your dad and sister could both be prosecuted for the mags as well. It isn't worth it. If you gotta have em, move to a free state where it is legal to own them. Otherwise, buy a lot of ten round magazines and learn to change em out fast.

Even tho it is such a trifling matter, and an affront to any person's Constitutional rights, anyone involved in such an activity, if it was planned in advance, is guilty of a conspiracy to violate this law, which, whether or not it is a misdemeanor or felony itself, the preplanning is a felony, possibly under Federal interstate commerce law, as well as Maryland state law.
