I was rear-ended on Saturday morning. My car is totaled (honda civic was hit by a dodge ram). I was rushed to the hospital via ambulance as I passed out. My neck and back are in a lot of pain. Think I have some major whiplash. My insurance agent said the most I will get is $8000? Is this accurate. And why won't he return my calls? I have no idea where my car was towed. Isn't my insurance agent supposed to help me locate it?

You need to contact the PD that towed your vehicle and advise you insurance carrier where it is located. They can not move your vehicle out of a tow yard without you releasing it. You do need to mitigate your damages and find this info ASAP. Some insurance companies will only pay for reasonable towing and storage.
Also they can not tell you how much they are going to pay you for your truck if they have not even seen it. If your vehicle is a total loss, they will pay you Actual Cash Value not what you paid for the truck or what you owe on it.

No..your insurance agents job is to sell policies.

You are the owner of the car and an adult. At sometime, you have to act like it. It is your responsibility to know where your car is. If you parked your car illegally and came out to find it had been towed - is it your agents job to find it then? No. So why is this different?

The police should have given you something showing where your car was towed to. If not, call the officer or the police dispatch and ask them where your car was towed to. If you have your case number that will be helpful. But they should be able to locate it with out it. Most likely the car was towed by rotation.

As far as how much you will get paid - ask the adjuster that is assigned to handle the claim about that. (An adjuster's job is to investigate and settle claims as appropriate). Adjuster's can not answer questions about rates and agents really can't answer questions about the value of claims. It's works best when we stay out of each other's sandbox.

Unless the accident was your fault, your agent wouldn't be telling you what you would get for your car. Since you were rear ended, it would be the fault of the other person, and their insurance will be settling with you, although your agent should be in contact with them on your behalf.

No, he is not responsible for telling you where your car was towed to. Get a copy of the police report, it will tell you what you need to know, including where your car was taken.

Sounds like you got a crappy agent. Call him again and demand immediate attention. He is the agent, not the claims adjuster. There were car damages and physical damages.HE does NOT know what the payoff will be. If no response within 24 hours, call an accident lawyer. You are entitled to damages and you are entitled to a fast and decent service. Report the lawyer to the bar assoc. if no results.

to find where your car is call the police and ask them as they are probably the ones who had it towed

don't believe much to insurance agency, their job is to save as much money as they can. i got the same problem year a ago. it sound like not your fault and hurt badly from this accident. you could get up to $200000 , try to get a good lawyer, get you car fit or new car (if necessary) , get pay for all hospital bill, lost of time, lost of paycheck (if you miss work), get pay for physical and mentally damage. don't let this chance go by nothing. try to get a full benefit out of it. turn your bad luck into a good one.
