What you could be referring to is "Shock Probation". An experiment, still in practice. Under the guidelines of the participating states, offenders convicted of and jailed for a misdemeanor or felony can be placed on probation after serving thirty (30) to sixty (60) days. This practice is usually reserved for first time offenders and/or where the judge has had a problem deciding whether to commit the defendant at all, but I did say usually. There are several cases where the defentant was not a first offender and was awarded the probation anyway.

Well uhhh... This wasn't in America, but it was in a different civil, democratic country. Sentence was life, served 5 years and got probation for 5 more...
-First hand information and second hand information. His gf's sister told me about it first, then he told me about it a few weeks later.

i havent heard of a sentence being shorter than life for capital murder unless they win the appeal.

USUALLY A PERSON IS SENTENCED TO LIFE WITHOUT ON A CAPITAL MURDER.
IF WE INCLUDE JUV TIME, 2 YEARS AS A JUV AND RELEASED NOT TRIED AS AN ADULT AND SERVED JUV TIME ONLY. WAS NOT RECHARGED AS THIS IS DOUBLE JEOPARDY.
