You need to contact the social services department of your area. They will be able to point you in the right direction. You also need to notify the school psychologist and principal, as well as his supervisor. The military takes a very dim view of adultery and he can well be court martialed. In addition to this, she needs to be able to consent to sexual activity. This is determined only by a psychologist and it is put in writing. If she has been determined as not being able to consent, then he is definitely committing a crime and can be reported to the police, and the military. With a mental age of 12, it is unlikely that she has been deemed able to consent. Furthermore, if you are not her legal guardian ( and the parents often aren't) the guardian must be immediately notified. This is a time bomb situation. He has likely done things like this before and who's to say whether he's using a condom and if he has diseases that can be transmitted to her? Good luck and get on this yesterday!

Talk to your local police, they should have some type of victims (sp) rights advocate. If she has been dianosed with a mental handicap they can help you. If she was convinced to do this willingly it can get complicated, but you are right about going to his CO. More will happen there than can be legally done I've worked with the handicapped for years and things have changed so much, that it is hard to find the help and info you need. If your PD does not help, find a organization in your area that works with , for MR/DD most of them have an advocates group. Email me if you want more detailed advice

She is 18, so this could be a problem. He and the Army will probably say she was a consenting adult when this happened . and he will say he did not know she has a maturation problem. Did this happen on a school trip? If so, where were the chaperones? If it was not on a school trip, how did he approach her elsewhere? Were there witnesses who may have seen him pressure her? I would pursue it by notifying his command. You may not get him on the mentally challenged 18 year old however, the Army frowns strongly against adultery. There is punishment under article 15(military justice) for adultery. You might want to make sure that he is guilty as doing this could potentially ruin his career not to mention his marriage. If he is guilty he deserves it but you might want to make sure that you have proof.

In most states, it is against the law to have sex with mentally challenged individuals....she is not able to give consent. What a sick b*st*rd. I'm very sorry that this has happened to you and your daughter.

Report it to his superiors. What he did was to violate Article 120 of the Uniformed Code of Military Justice by engaging in carnal knowledge of a woman who is not his wife. Considering the fact that your daughter may not have had full mental capacity to consent to sexual relations, he could also face court-martial for rape under than same article.

You can take legal action. There have been cases like this before--some have come out well, some haven't. You can claim that this is essentially rape.
