I moved to Phx from FL and been here for 7 months. My relationship that I came here for fell apart due to my x not trying. Now I'm 6 weeks pregnant. Can I leave back to Florida with my child when it is born? I can't leave now because I won't have insurance.

He is being an a** atm. He doesn't care what I do but I know his mother will go after me for the child. I'm just scared I guess because I have no one here.

yes you can move... and if he wants to go for visitation the good thing is he has to go to where you are living to file the petition for joint custody...so its him its going to suck for...not you... you could move to washington and still he cant do nothing about it... and as for his mother she cant come after you for rights unless the father is dead.... good luck... i went through the same thing thats how i know =)

You can't leave without the consent of the father. Same thing when you travel overseas, the father needs to consent this. If this is in fact the baby's father, he can legally keep you there until the child is 18. If you put the fathers name on the birth certificate, then that man has rights to this child, and is considered to be the father. If you don't put his name on the certifaicate, you have a better chance of leaving and getting away with it. But when the father has rights, you can't just up and leave without the father telling the judge that its okay. Custody issues and battles are very tough and are very hard. For everyone involved. Your child is going to suffer the most though. Your child has a right to see its father, your child will want to see its father and if you leave, then you will be denying your child what it deserves. It doesn't matter if its only newborn, you are taking your child away from its father and that is not cool. Think about your baby, get a job and stay where the father is. You have a responsiblity to this child. I have known far too many men that have wives and girlfriends that deny them the right to see their kids. Don't be that woman. You will poison your childs heart.

I believe it depends on any agreement made between you and the father, and the courts.

If he wants visitation rights or joint custody, he can ask that you not leave the state, and can go so far as to get a court order to stop you. If he doesn't care, then it won't be an issue. If the courts give you primary custody, then you will be able to leave.

You should certainly discuss this issue and child support with him. Don't agree to or sign anything without consulting a Family Attorney.

The only thing that could and can stop you from leaving the state after you have your baby is if the father takes you to court to fight for joint custody and if that happens and the judge were to give him joint custody you could be court ordered not to move ut of state. Other then that if the father does not take you to court to fight for joint custody then yes you can leave state. But if you go after him for child support you could have to go back if the courts order you to for DNA test and so forth. Good Luck and congrats ..

Well this is what happened to me. My son's father has never seen him and does not want anything to do with him, but he does pay child support. When I was about to move across state lines to attend college, my case worker told me that I had to get permission form his father to move. Without it he could come after me for kidnapping and then not have to pay his child support. All I had to do was write him a letter and get his signature, then sent it to my case worker, she took care of the rest. All in all it is better to be safe than sorry.

If he wants nothing to do with the child don't put him on the birth certificate. Have him sign away all parental rights. Check with the local court house to see how this is done.

only if you have a custody agreement that states you can not are you not able to leave state.like me and my babys father have a court ordered agreement i can leave state with my children but he can not.

YES you can. you just have to inform the babies father you will be leaving and you might have to put up for the travel with visiation.
