To make story short… we encountered a truck flashing people to get people to get out of his way. We encountered him and he flashed us then flicked on and off a red light. We moved over and flashed him once. He then begin to slam on his breaks and then stopped in the fast lane so that he had to be behind us. (we thought he was going to kill us or ram his truck into us). I called 911 and they told me to keep driving and if he follows you CHP will be there. He got off the exit and a cop car was waiting. So we pulled over. My boyfriend rolled down the window to talk to the police man, and the guy from the truck came to my bf and grabbed his head and slammed it into the steering wheel, cussing and telling me to get off the phone. We then knew he was a Homicide Detective. The Police man denies ever seeing anything, and the Homicide guy took off in the truck. We were cited with a ticked for going over 100 (which we wernt) from the police man, he never witnessed anything. We're now at blame.

My boyfriend has never sped before, he has a clean record. So do I we both respect CHP and Sherrifs and have never broken the law.

* We thought we were in danger by a road rager.

* the Truck did NOT have continuous flashing lights, he was flashing us (like others would) to get by, then flicking on a red light.

*The Homicide detective never identified himself, and never showed us his badge. he never talked with us either.

*We wernt speeding in the first place, so he had NO reason to pull us over anyway.

* Officers are not allowed to pull over cars on the stretch of freeway where we were, we had to go to a safer place anyway if he was pulling us over.

* I told CHP disbatch what the car was doing, and about the red light, and they told me to keep driving to get away from him, they never told me he was a 'police' vehicle. (ive never seen one)

*people add lights to their cars to blind people or for decrotive reasons too.

*The police man who we thought was going to get the guy, says he didnt see the homicide guy slam my bf's head into the steering wheel and cuss at us, and tell me to get off the phone. He was standing RIGHT there and I saw him watch everything.

* We were NEVER going 100mp like the homicide guy said, plus, they gave us an infraction not a mistomener = 100mph. The Police officer NEVER saw anything at all of what happend in the first place, and wrote the ticket before he even talked to my boyfriend, and we never admitted anything either.

We thought our life was in danger. The homicide guy was road raging us. he was going to a homicide (CHP told us he had no reason to do what he did- the person is already dead) (lol).
We wernt doing anything wrong in the beginning at all. not speeind, we let him over, everything.

What should we do? my boyfriend has neck pain now too.. dr. says he has a strain.

Should we settle if they dismiss it? or should we go ahead and sue the homicide guy

sorry forgot these things...

*** the entire conversation of me, the slamming against the steering wheel, the cussing .. is all on CHP Dispatch recording. (because I was on the phone with them for the most of the time.. i called after he passed us)


** and.. the Sherrif's department has already ordered to hear the CHP tape. because they are doing an enternal investigation.

but I was told by CHP and another city's dept. to go to Internal Affairs and NOT the sherrif's dpt that wrote the ticket.

PLUS I was also told it was supposed to be a SOLID CONTINUOUS RED LIGHT.. NOT FLASHING....

remember he turned the lights OFF for the remainder. until the exit...

he had no radar no laser nothing to determin our speed. he was guessing. and he didnt write the ticket the deputy that was at the exit did.. and he didnt see anything...

.. I respect Law Enforcement, I'm not a 'cop hater'. My family is in Law enforcement.. so please dont say we are cop haters..

First, you are in California or it would not be the CHP. They record all calls, but note, they only hold them for six months. So action now could give you the proof you need.

Second, if your bf has any injuries, photograph them. Also, keep your phone bill to prove that you called, and if the tape has gone missing, you have proof that it was a call, and if before the 6 months that they are tampering with evidence.

Third, bf needs to fight the ticket. The question is how did they clock your bf if they were not on the highway. Copies of the chp chatter will document that.

Fourth, he needs an attorney. Bf needs to make a complaint at the agency of where the detective works, as I am guessing that he was not CHP, and a complaint at CHP against the officers. That is through Internal Investigations, (IA). That is what IA does and wants to do. Weed out bad cops. Wish you bf good luck.

Liberal courts uphold the rights of the individuals, stable and undesirable, regardless of what they are imagined to have completed. Call a lawyer. You can lose your license for going over 100 (even with a spotless driving record), so the last thing you want to do is to go into court and accuse the officer of completely inventing the phony ticket. Your court case is probably not the place to bring accusations against the officer--it will look like more desparate lies by you (really--there is a conspiracy--the cop just made all this up to protect another cop, he didn't even see my car driving--yes, I was assaulted by the officer. You'd sound like a crazy person, even if this is all true).

You need a lawyer for your traffic defense, and you can ask him how to go after the detective for everything he did. There were two of you in the car, so at least you have a witness. He'll need to help you gather evidence, including your 911 call. If you don't know how to get a copy of your 911 call yourself, you need a lawyer--that call is your defense, in my non-qualified opinion.

I don't think you'll get satisfaction legally. If you know how to find the detective, you could try illegal means, but serving your own justice is dangerous and could land you in jail.

You can also try dealing with an internal affairs officer at the police station, but I wouldn't call the cop's front desk to get connected to one. I'd call a politician (mayor or whatever) and get the name of the appropriate person from their staff. I wouldn't trust the cops in your town to connect me to internal affairs (if they have such a department), they may just send you to the same detective that assaulted you.

the answer is no. please go to the police station or your area district attorney's office and tell them what happened. you will have a tough job in front of you, ie; getting the chp officers name, getting the detectives name. they will try real hard to discourage you. do not give up. get a lawyer and have them ask the ACLU research team to assist. this seems to be a very good case that if managed correctly could and will result in monetary re-numeration and discipline for the officers involved. please do not let them bully you into saying they were on their way to a scene of following somebody, most police follow people in groups and even if they were responding to a scene they must put on lights and sirens when approaching intersections and passing motorists. what the detective who slammed your head into the steering wheel assulted you period. thats a felony.

No one should have their head slammed into the steering wheel! Not sure why your bf flashed his lights back at the truck, but still didn't deserve that. I would try to contest the ticket...hopefully the policeman won't show up to court and it will get removed. Sorry about your bad experience!

Please, please please pursue this. Police brutality in America has got to stop. Ignore all of the thumbs down marks people are giving to the good advice you are getting. They are probably the same type of police that do the exact thing you wrote about. My boyfriend was beaten and arrested for being in a car that kinda sorta not really looked like a stolen car. They beat him and his friend up. arrested them and then took them to the police station BEFORE even asking for registration, insurance or i.d. PLEASE NOTE that the car belonged to my boyfriend's mom and was NOT the stolen car and did NOT look similar in many key ways...like the windows weren't smashed out!!!! Now they are trying to get my boyfriend on charges of resisting arrest...which he didn't do. He said he didn't even try to protect himself when they were hurting him because they were police.

Get a lawyer.

Go to the police station and file an assault charge on the officer involved.

That way when you go to court you have some substantiation for your story. Keep in mind that a officer so quick to violence in a situation like that has to have a number of complaints on his jacket.

Obviously your BF was mistreated, that's not as rare as it should be.

If you were so worried about a "road rager" then you should have just moved over and not pissed him off further by "flashing" him. You don't antagonize a rager. You get the hell of out their way.

I suggest a lawyer. You were never shown any form of I.D. and the guy physically attacked you. Whoever the other cop was shouldn't be able to testify against you if he's claiming he didn't see anything.
