If an unmarried girl has a married guy as a boyfriend and has physical relations with him, is it possible for the married boyfriend's wife/family to take legal action against this unmarried girl for having a relationship with him? If yes, what is the expected punishment as per Indian law?
P.S The unmarried girl is NOT ME. Its someone I know.

Thankyou Poker for reading my other question and answering this question in in that perspective. By the way, stoning a person to death doesn't happen in the cities and I live in a city. I think its a crime to take the law in one's own hands by stoning a person to death.

Sweetu, stoning only happens in villages and not in cities. The news about stoning incidents mainly comes from north east India and not south India and I'm from south india.

Nothing. No punishment for any girl indulging in any form of adultery. Let me bring to your notice section 497 of the Indian Penal Code, provision for punishment for adultery. It provides whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such case the wife shall not be punishable as an abettor.
What you see in this provision that even a married lady if indulge in adultery with some man other then her husband will not be liable for any offence, although such man will be punished for this offence of adultery & in your case the girl is an unmarried & indulging in adultery with a married man, there is no question of any punishment for her in any other provision of the penal code or any other legal provision of the country.

Have no idea about Indian law but here in the US your sister didn't break any laws...It sucks that her boyfriend was forced into an arranged marriage while he (obviously still loves your sister)...
P.S. This is why I hate arranged marriages...hopefully your family won't stone her or anything for disgracing your family because that it was I see on the National Geographic or Discovery channels about other cultures...
For me personally, when a married person cheats with a single person, the married person is the one who is at fault...

ya, making relation with someone who is married is punishable under indian penal code, i am not sure what act will go with this kind of relationship but working as crime reporter i saw many cases in which poeple were embaressed not only by society but also by the court too. in other words indian law define these type of relationships as illicit. but how can a law can bound us to make love as both of the persons are adult and do love by thire own will and in full consicness. i think when we discuss about love then it pure matter of heart .........far above from all laws and penals

You can freely have sex with a married man, nothing will happen to you. The married guy might get in trouble with his wife who may file cases against him for mental cruelty u/s 498a, divorce him on grounds of mental cruelty, and seek maintenance and child custody from him but you will be quite safe.

It is a punishable offence for the guy. Not for the girl. in this case the girl is an abettor.
there is nothing to be done if it is from the man's side, except keep on slapping him continually.

to all those people who have replied- in india-punishment is stoning.. i am sorry but you people are so ignorant and stupid. stoning happens in conservative muslim countries like afghanistan and not a educated, multi-cultural country like india... probably you all need to check your general knowledge before giving such stupid answers...you have got a lot to learn about india so please think that you are hurting indians by such stupid replies. indians will only laugh how ignorant you are.
