TWO YEARS AGO MY SISTER GOT HER KIDS TAKEN AWAY FROM BEING A DRUG ABUSER AND I HAVE HAD HER YOUNGEST SINCE WELL KNOW SHE HAS A COURT DATE IN DECEMBER AND IM PRETTY SURE SHES GONNA GET HIM BACK SINCE WEVE WORKED SO HARD TO GET HER CLEAN,..WELL MY QUESTION IS WHEN TAX SEASON COMES AROUND SHOULD I BE ABLE TO CLAIM HIM SINCE I SUPPORTED HIM ALL YEAR OR SHOULD SHE GET THE MONEY I KINDA SCARED TO BRING IT UP BECAUSE I DONT WANT TO FIGHT ABOUT IT OR END UP FELLING ASHAMED ANY SUGGESTIONS? thanks:)

i already know the kid will be alright and so did the social workers that is not about the question i want to know what i should do about the issue

Every state has a different length of time, but in most states if you have physical custody of a child longer than 6 months out of the year then you are entitled to claim him. You would have to double check the law for your specific state (just call an H&R Block or a Jackson-Hewitt and they'll tell you for free) but that's how it is most places.

I personally think that this is a very selfish question, the better question is will the child be ok. You should be thinking about the fact that this child has probably been through hell and back because of all the stuff this mother has put him through. Quit worrying about the money. You are obviously a great person because you took the child in, just leave it at that for the sake of the child, and don't worry about it. Good Luck!

After being without them for two years I do not think that they will move them in with her so quickly. They are going to need to adjust. It is usually six months out of the year but you will need to check. It is the end of Oct. already I would think that you can claim him. Make sure that you double check. They have hot lines at tax season.

I think the law states that if any person living in your house, that you are providing for (that doesn't pay rent) over 6 months you are allowed to claim on your taxes. Honestly your sister should want you to claim the taxes. You deserve it.

Well if he's lived with you and you supported him than you should claim him.
Also by law she can't claim she's supported him all year since she hasn't.
