Jerome is an elderly man who lives with his nephew, Philip. Jerome is totally dependent on Philip’s support. Phillip tells Jerome that unless Jerome transfers a tract of land he owns to Philip for a price 15% below market value, Philip will no longer support and take care of him. Jerome enters into the contract. Discuss whether Jerome can set aside this contract.

Philip acting as the guardian of Jerome so to speak.

Yes Jerome can set aside this contract as invalid and unenforceable from the beginning since this contract is detrimental for the well-being of Jerome for transferring a land owned by Jerome for the price of 15% below the market value in the prevailing price. Under the false pretenses and deceit of promise and threats that if Jerome wouldn't surrender this track of land to his nephew under duress then he will not take care of Jerome for the rest of his life. And since he is totally defendent on Philip for his livelihood, he was cheated for being old and uncare for under deceit which is against the law.

A contract is valid if freely agreed upon by the parties as long as it is not immoral and against public policy.
