Okay, so I am 7 months pregnant and am a hostess at a restaurant. I recently started having complications. My job requires me to escort people to their seats when they arrive. It also requires that when no customers are arriving, I must stand at all times. 8 hours straight is a long time to stand without a break, and I find that I'm in severe pain after shifts.

My dr would have no problem writing me a note reqestig that i'm allwed to sit down in-between seating customers (on a stool behind the hostess stand). My only question is this--is the restaurant required to accommodate me? Or can they argue that because standing up the entire shift is part of the job reqirement, that I either have to stand or quit?

My job is not pleased that I am pregnant and I feel that they would jump at the opportunity to fire me so they can hire someone else that is not pregnant.At this point it would be very hard for me to get a new job, and I most likely only have a month left working anyway.

First, it is actually a health issue being on your feet for that many consecutive hours at 7mos pregnant. If you haven't noticed already, your feel will begin to swell, and you could begin to have circulation issues.

Second, get the note from your doctor & present it diplomaticly to your employer. Tell them you are still capable of doing your job, but for your health & the health of your baby you have to modify it slightly.

Third, if they fire you because you are pregnant & need special accomodations or while you are out on maternity leave (or upon coming back for that matter) and the reason is that you can't properly perform your job because of the pregnancy, then you have one hell of a law suit against the owners.

I was working the same type of job until 3 weeks ago. I am now 39 weeks 3 days. I know how you feel. Honestly, I just sat down. But, if you feel that they would jump at the chance to fire you, then get a note from the doctor. It is a legitimate reason to request a note. I wouldn't quit now, that is what they want you to do, but not necessarily what is best for you if you are trying to make a bit of extra cash. I wish I had kept working until my baby was due because I am a bit bored! Do what you think is best though (you know what you can handle).

I don't think they are *required* to accommodate you. In Georgia, your boss can fire you for any reason. FMLA only works if you have so many employees. So if its a big chain restaurant you have a better chance at holding your job but you wouldn't get paid. The thing is is if you can't continue to do the job they can fire you. I think.

1. find out what the HR policy is on pregnancy.
2. they cant fire you for being pregnant in some states.
3. your health is more important that that job. you loose ur baby at work, they are liable.
4. get ur docter to excuse you. if the job fires you when u return, then seek legal help. you most likely will win.
