I need some help. A friend brought an informate to my house he didnt know he was an informate he gave him 1 oz of marijuana and now me and my spouse are getting charged with distribution and conspiracy. we never sold or gave this person anything. how can i beat this?? what could the outcome be??? what kind of evidence do they need to convict us of this??? plus when they came to my house they didnt even search it. if im i drug dealer why didnt they search my house???

Get a good lawyer! You kept your mouth shut too! Seems like this was a setup from the getgo and they wanted you two to spill y'alls' guts and give up a name or two! Was there a phone call before this friend and his "friend" came over to your house? If so, then conspiracy to distribute law was broken! As for the distribution charge, if you didn't handle the reefer physically, you should be alright on that one! But in some cases, only the word of those around you wanting freedom will be enough to convict! Most of the time possession of 1 oz. is only a misdemeanor, but this is a dealing charge and conspiracy charge, felonies both! Remember, when drug laws are broken, you have no friends atall! Just an old adage to remember for the future!

Conspiracy of marijuana isn't a charge, what did marijuana conspire to do? Distribution of marijuana is a charge. If your not a drug dealer why are drug deals going on in your house? They'll probably just trying to tie you up in this to get you to turn and rat on your friend, which you shouldn't do, nothing lower than a snitch. Get a good lawyer, if your friend is a good friend maybe he'll help with the bill since he got you into this.

There are no friends when it comes to a drug bust. Get a good defense attorney. If you cannot afford one, get a public defender with experience in drug cases. Why would your friend give someone an oz and money not exchange hands?

Right now, you're just a victim of circumstance and because it was in your dwelling, you need to come clean to your lawyer and have the charge(s) reversed even if it means that you have to take the stand against your friend because by rights, they can seize your house and everything in it.

GET AN ATTORNEY. You might be able to use a Derivative Entrapment defense. As for why they didn't search your house, they didn't need to. The transaction they are charging you with ALREADY HAPPENED, and they have that evidence (the 1oz. of pot). Go get an attorney.
