If the private property has no trespassing signs on it and you are not anywhere where the public could conceivably "be invited", you might be okay. Of course, you would need permission from the property owner to stay in your car and that property owner would need to take your keys to prevent you from driving under the influence. It's not a dumb question. What's dumb is that the police actually arrest people for DUI who are asleep in their back seats of their car. The police claim that as long as you have the ability to drive the car and you have the keys in your possession, you can drive under the influence and they have a right to issue you a ticket.
I think that's down right stupid. If you are smart enough to crawl into the back seat and sleep it off, you aren't driving drunk and you are not a threat to anyone. Therefore, the police should leave you alone, but they won't.
If you are walking on a public sidewalk and you are slightly "off balance", the police would arrest you for public drunkeness. If you call your son or daughter who is under 21 to come and get you, the son or daughter can be arrested. Seems to me, no matter how you look at it, you're screwed unless you have a sober adult come to get you. Wouldn't it be better if the police gave you and other drunks a ride home to keep them safe instead of giving tickets? Maybe we should have Friday and Saturday night drunk buses wherein for the cost of a drink the drunks can board the bus and be transported to their homes safely.

If the owners of the property dont press charges. You should probably sleep in the back too just in case a cop thinks you were drunk driving.

Take the keys out of the ignition that is a DUI and trespassing you will get just a warning. If they make you walk somewhere else. Good luck. Find a church? Any body that u can call? Not dumb actually responsible.

As long as your keys are not in your pocket or with in easy reach of where you are in the car, then yes. It is possible and legal to get a DUI if you are sleeping in your car with you keys in your pocket. I know several people that have recieved DUIs when cops caught them sleeping in their car in a friend's driveway with their keys in their pockets. They all appealed the conviction and lost.

Laws vary, but one thing to remember - as long as the car is in park and the keys are not in the ignition, you're not driving. There's no law saying you can be drunk in your car, you just can't be driving.
