We have a house which we rented to a family a month back. Then my husband had to go out of country due to some family emergency. There was some touchups on the wall to be done. The tenants had put almost half of their stuff n the house. I spoke ti them n asked if I could get the wall paint n hand it over to them. They said yes. But due to hectic life, I couldn't go n hand over the paint. When my husband came back after 2 weeks, this tenant said they didn't start living in cos we had to do some touchups!. n she was staying somewhere else. But their stuff was right there in the house. She now says that since she was waiting for the touchup to be done, n didn't start living , she won't be paying themonths rent. Are we being cheated?

Yes, you are being cheated. Basically, if you are "storing" their stuff there, they have to pay for that no matter what condition the property is in. Give them a three day pay or quit notice demanding they pay or get their stuff out. You can copy the one in the link below and paste it into a word document. Mail it to them certified mail with return receipt requested, then wait until you get back the receipt. If they do not have their stuff out in three days, you have the right to move their stuff into storage and charge them for it. Then take them to small claims for the rent money, plus storage money, plus cleaning and moving costs. You will win if they have not paid.

If they had the keys and their stuff in the house, they had legal possession. They owe rent for the full month.

The need for touch up painting does not make the house uninhabitable by any means.

Do not accept partial rent and serve the required pay or quit notice per your state's landlord tenant laws.

Yes, you are being cheated. One does not need to live in a rental unit to be considered as occupying it. You're off to a very bad start with these folks. Don't let them take advantage of you right from the start. Make your position clear, demand the rent, and if they refuse to pay it, evict them.

You can do better.

did they sign anything 4 the house if so they should pay from that date it only needed a bit of paint they could have lived there i think there trying to cheat you out of the rent

Yes, you are. They are already throwing up red flags! If their stuff was there, then it is being occupied by them. You are being taken advantage of. Please put them in a month to month lease and make sure to include a sufficient amount of money for any rent paid after the 5th!!!!!

Yes, your being cheated. Poor excuse though, I never heard of anyone waiting to live there over some paint when they already had their stuff there

They took possession of the property they owe rent. Bettor keep an eye on this one they may try something else.
