The "tenant" is my 32 yr. old son, who is taking advantage of me. Before he moved in 2 months ago, he agreed on a certain amount of weekly rent. Last week, he decided to lower his weekly payment. I feel helpless in this situation, and wish I had never agreed to it. I'm divorced, and live on a tight budget. Any help will be appreciated. Thank you.

He has also physically hurt me, to make things worse. I feel very intimidated. He's always had a bad temper.

You should have made a written agreement with him, especially since he is a relative.

Do you own the house? Kick him out.

A written agreement is always good in any situation like this. You can find standard contracts available on CD's and probably online. Sorry your son is taking advantage of you. Don't let him get by with it, for both of your sakes.

If there is no written agreement his tenancy is determined by the interval of rent payments.

So he is a week to week tenant by default per your state's landlord tenant laws.

You should give him proper written notice to terminate his tenancy and then evict him.

go to the court house and have him served eviction papers by the courts and give him written notice of at least 30 days to vacate. if he does not vacate after 30 days(or what your state statute requires 30 or 60 days) you have every right to change the locks. if you have given him 30-60 days notice to vacate, he CANNOT sue you for illegal eviction. contact your local courthouse they can direct you to the proper office.
