What exactly are you annoyed at?

Is it that you continued to feel pregnant after the abortion or is it that you moved to the anti-choice side?

I know what a molar pregnancy is, and it's very hard to diagnose, even under the best of circumstances. Even (most) doctors won't diagnose it as such unless the "mole" is passed and the mother reports seeing what looks like a grape-like cluster of gray matter. Sometimes an ultrasound is just not enough to diagnose a molar pregnancy.

Do you have a legal case? Doubtful - but only an attorney can tell you for sure. Most of the time, medical malpractice suits are brought against nurses or doctors for failing to provide a minimum standard of care. The ultrasound tech was not providing care, she was providing a diagnostic service. The care you received was not dependent on that ultrasound - since it seems you would have had an abortion anyway.

Anyone can bring a legal suit against anyone else for any reason. That does not mean, however, that there is justifiable cause for bringing legal action; and it doesn't mean the defendant is at fault. In your case, **my personal opinion** is that you don't have cause for legal action.

NOTE: I am not an attorney, and nothing written in this answer is given as legal advice, nor is it meant to be taken as such.

I didn't believe your story last time, and I still mostly don't.

But on the chance you are serious, then the real issue is if you signed an informed consent form before the operation. I am certain that you would have if you are telling the truth.

That would prove that you were aware of the risks and accepted them.

Any case would almost certainly revolve around the issue of informed consent.

BTW, the page you linked to seems be be saying that the molar could be microscopic a the time of your abortion, and then grow later, and that it can actually recur based on certain hormone levels at certain times. all of this would mitigate AGAINST the clinic knowing at the time you were there....

The fact that you lead both questions with your "immediate depression" is what seems suspicious to me, as ultimately it is not relevant even one iota to your medical case as you describe it later.

Either you have "buyer's remorse", using the language of anti-choice people almost verbatim, or you have a rare medical case for which the medical system seems to have acted on and cured you of.

Which is it?

What is it you regret? The moler pregnancy was never viable. You would have had to have been treated for removal of the material at a hospital anyway, a procedure known as a D&C would be performed.

Other thant he fact they may have been outside the bounds of care they're supposed to deliver, they didn't do anything wrong. There isn't any liability on their part. If there is any it is with your initial physician who should have tested you twice. The hcg levels would have indicated a moler pregnancy.

Contact an attorney. This story is still very unclear.
