my friend is in serious debt..

she has had a letter from the city council saying that she has been overpaid in housing benefit, only £230.00

Plus, she has had a letter from the debt collectors on hbehalf of capital one of intentions of court proceedings.

The capitalone debt is saying that she needs to find £500.00 by 31.10.07 but there is no way that she can

Will she go to prison if she does not pay.

tell her to contact both of these companies and tell them her situation they will normally try to find a way for her to pay it be it £10 a week or whateverand if she calls them they (capital one) will be able to write off any charges on the account to bring the amount down. They would rather work it out between her and them as it is cheaper than court, so tell her to call them and get it worked out.

This is a civil matter.
There is no prison at the end of this.
Just county court judgements or bankruptcy.
You can go bankrupt yourself and wipe out all debts, but only if you have nothing and the home you live in is not yours.
It is always posible that the companies concerned will come to an agreement to pay it off in small monthly payments .
Try making them an offer.
Dont ignore it, the debt will only get bigger as they add court costs.

No capital one can't do anything except write and letter and make calls. If they do go down the court route it will be the country court. Its a civil matter and no one is going to prison. Pay your debts at a rate that you can afford and you really can't do any more.

hi the answer is no to both debts the over payment of housing benefit they will just take a small amount each week to pay it back as for cap one they all say that o scare you to pay don't worry just make an offer to pay and they really cant refuse if they do just say its that or nothing they will soon take it
