I brought my fiance over on a visa for marriage. After 8 months into the marriage, he now wants a divorce and wants to return to his own country. Would i have less problems filing for divorce after he returns to his country or should i quickly file for divorce now? He left me after 5 1/2 months of marriage 'to find work'. (yeah, right). Now what? I need some legal help quickly.

In response to the 'witty coleen', I LEGALLY brought my fiance over on a FIANCE VISA...which took over a year and practically ALL the money i had. I have not done anything illegal...EVER! And i seriously resent any 'airhead' suggesting that i have.

Start now and be quick or they will never find him to serve the papers and he gets to keep his visa and green card. At least you found out hopefully in time.

Yeah you sure do need legal help. INS is going to be very interested in the fact that you brought him over to get married and now he is wanting a divorce. What the two of you have basically done is frauded the Government and that's against the law...and that being a Federal offense means you could land in prison for quite sometime...I suggest you get a lawyer ASAP

Yes, you need a divorce lawyer and you need Immegration. Both can help you with the problem. I guess this guy does not have a green card or other documents that will give him citizenship or free entry to the USA.

You should have started this when he left you. Now it will be difficult to find him and get him deported.
Of course with the current situation, Bush will probably give him citizenship and prevent the divorce.

Go to the nearest lawyer and start proceeding your divorce and I not sure what it called but they can keep him here until your divorce is final. If you have a friend that is lawyer go to him and get him to start it right away or if you know someone that knows a lawyer get intouch with that persons Don't delay Do it as soon as possible . Monday is a must. Don't let him know you are ahead of him do it quietly. Better results

Definitely while he's here. It would not only be difficult to have him served for divorce, but also very costly as well (because they have to send someone from here to serve him over there. Also all the signatures that are needed. My sister just went thru a divorce and he had to be served in a different country.

It will be much easier to get the divorce after he leaves the country. You can then file for desertion reason and it won't be contested. This will also make it cheaper. Also ensure you report the status of your marriage to the immigration department and the Department of Homeland Security. This will also aid you in the divorce.

Divorce him NOW before he has time to leave the country. Otherwise, it can take years to get a divorce because you will have to PROVE abandonment, which, in some states, can take 7 LONG years.

Not a lawyer so can't give you legal advice. As a 14 year paralegal, I can imagene what the attorney I worked for might say to his clients...

BEFORE - otherwise you may not be able to serve him, the state may lose jurisdiction over him, etc. Even sooner than before he leaves, do it NOW!

if you wait untill he leaves you are goign to have to file a contested divorce and it will take 18-24 motnhs min. but if you go talk to your laywer and explain the situation you can at least have all the papers drawn up and have him sign them BEFORE he leaves, make sur eyou let the INS know after you do divorce because he shouldn't be in this country if he is no aloud to be here,
