My uncle has been living with my grandfather helping him out well my Dad moved in also and runs over my g-pa yesterday my dad called the police to get my uncle evicted but from what I understand about law in florida is they have to get an eviction notice for anything to be legal is that right

There's not enough information posted to conclusively answer your question. It really depends on the circumstances. If your uncle has a formal lease, then your father has to follow the procedures contained in the link below to evict him. (It's a link to a LOT of information, but your question is very broad - it's the residential landlor-tenant statute.) If your uncle is living there without a lease but as a family member, it becomes VERY complicated.

When I lived in Florida (a couple years ago), an eviction, even if rent was not paid, was required to be filed for and notice served by the Sheriff. It had a 30 day grace period. This could change if small children were involved.
