From a legal standpoint
The division winners in each conference automatically qualify in the following manner
1) The first three seeds in decreasing point order
2) If tied in points, the team with the most wins gets the higher seed
3) If tied in points and wins, the team with the best record in head to head games
4) If tied in points and wins, the team with the best goal differential gets the highest seed
The 5 best non-division winners will also advance to the playoffs and be seeds 4 through 8
1) If tied in points, the team with the most wins gets the higher seed

3) If tied in points and wins, the team with the best goal differential gets the highest seed
As for the Oilers
They are only two points out of the playoffs now
Sadly, that gap will INCREASE as the season progresses

If the playoffs were to start today - not even a month into the season, mind you - it would look like this:
Eastern Conference:
1. Ottawa Senators (Northeast Division)
2. Carolina Hurricanes (Southeast Division)
3. Philadelphia Flyers (Atlantic Division)
4. Boston Bruins
5. Montreal Canadiens
6. Toronto Maple Leafs
7. Tampa Bay Lightning
8. New York Islanders
Pittsburgh just misses.
Western Conference:
1. Detroit Red Wings (Central Division)
2. Minnesota Wild (Northwest Division)
3. San Jose Sharks (Pacific Division)
4. Calgary Flames
5. Colorado Avalanche
6. Columbus Blue Jackets
7. St. Louis Blues
8. Dallas Stars
Chicago, LA, and Vancouver would just miss.
As for the Oilers, it's still early but they're not off to a good start - they're currently last in the Northwest Division.

Flames Fan has it exactly right. The first three are the division winners. If there is a tie between two teams in a division they go head to head, then division and conference records then if they are still tied goal differential. The other 5 are the highest point getters that are non division winners. And again if there is a tie between an 8th and 9 the team in points they go with head to records, and conference records etc. The 6 teams sens mentioned is in football not hockey. In the ahl it is the top 4 point getters in a division out of 6. I don't know if he meant that.

the top 3 teams in each division of every conference (east and west) automatically get in the playoffs as the top 3 teams. the next 5 are detirmened by how many points the team has, each win is 2 points, and i believe the losing team gets one if it is in overtime. yes the oilers have a chance

The top Team in Each Division fill the first three spots in each conference (east and west)
Then the next 5 in each division are taken by pts.
The Oilers looked good during pre-season but they are starting to look like they did last year when they lost Ryan Smyth. Not the greatest chance, but anything is possible.
