when you yell at a police officer and he comes over and gets in your face and then arrest you what is that called this matter was already being handled by other police officers and this cop jus butted in and got in his face and put his finger in his face and then the defendent started yelling at him and told him to getout of his face and stop pointing fingers and then the cop that butted in arrested the defendent for disordely conduct is that what it is called or what is it and can you dispute this

The charge would be either Disorderly Conduct or Resisting a Police Officer.

You really have no defense. Sure, freedom is speech is an
American Right, but when it causes a disturbance or interferes with an official police investigation, then it is a crime.

I sort of agree with Dog Lover, but it wouldn't be resisting. In order to resist, there has to be an intent to arrest by the officer, and the officer's actions prior to the suspect "resisting" would have to be significant enough that the average person would have assumed he was being arrested. Resisting an arrest would also have to involve physical resistance - the person being arrested would have to actually touch the officer.

In order for an officer to arrest anyone, the officer has to either have a warrant to arrest or probable cause to arrest (a warrantless arrest). Interfering with an investigation would be more than enough to establish probable cause (after all, interfering with an investigation is a crime in itself and in this case, it is a crime witnessed by the police officer). Whether or not the person who was arrested really was interfering with an investigation is something I wouldn't know without having more information on what happened.

But on the other hand, if he was arrested for disorderly conduct, then his behavior must have been extreme enough that he was publically disruptive. And again, I wouldn't know whether his behavior was extreme enough to justify a disorderly conduct arrest without knowing more details about what happened.

One can always dispute an officer's behavior. He just has to go down and file a complaint. He can also sue on the basis that it was an unlawful arrest. Whether or not he would win would depend on whether or not the officer had probable cause to arrest him.

So you yelled at a cop and then get nasty when he comes over and confronts you about it. It's called you're acting stupid.

Did you really think that yelling at a cop and acting belligerent was a good idea and would make your situation better?

So......if you never yelled at the cop and showed your fanny... the cop never would have come over and.........(wait for it)..............none of this would have happened - yet in your mind it's the cops fault.

What do you call it? Deserved.

i was really confused but from what i gathered you were resisting arrest or disorderly conduct and you are cold busted. offer a very sincere apology, maybe you'll get probation.
