I think that would fall under a domestic and when there is even suspicion of it, the police will arrest and lay a charge. It would be up to the husband's lawyer to keep it out of court.

In the Uk the success rate has to be at least 98% in favour of a conviction.As you describe this case not a prayer for a succesful prosecution.They try this one regulary a form of blackmail and be brave and call her bluff it will work assure you.

Rape cases in general are difficult to get to court - rape within marriage without good physical evidence and/or reliable witness is very doubtful....

Unless there was a witness (doubtful) it will be a "he-said, she-said" case.

She has to be credible.

She has to prove she said "no."

Since most rape cases have no witnesses, prosecutors bring them on evidence when they would probably not bring any other case (a tip-o-the-hat to the women's lobby).

They tend to have a high "not guilty" rate.
