Entirely depends on the laws for the are you live and the circumstances. In some countries there is no open container law. I would imagine different states in the U.S. have different rules and penalties as well.

Consdider this scenario... 2 with open alcohol in the back seat and 1 sober limo driver... perfectly legal.

In Califonia, the driver can get a citation for driving while an open container was in the car. It's pretty simple. If the two passengers refused to give up the open containers, it is the driver's responsibility NOT to start the car and drive. No excuse is possible.

To anticipate a question that often comes up in this discussion, the California Motor Vehicle Code makes an exception to this regulation, for the drivers of vehicles for hire, such as limousines and taxicabs. It does NOT make exceptions for drivers who have bags of open containers, collected for recycling.

A ticket for the open container. (unless it is a limo with a divider where the driver cannot access the back while driving)

The driver is responsible for the actions of his or her passengers. That applies to more than just open containers, so your friends have to be on their best behaviour (no littering, open containers, underage drinkers, unbuckled passengers in front seat, unbuckled passengers under 16 in back, etc.)

What state do you live in? Here in Louisiana we have drive thru daquiri's (I know spelling). So technically you can have an open container, becuase they serve you drinks (in a styrofoam cup) thru drive thru, but legally, you can't. I think the law is that you cannot have the straw in the cup, but some places put the straw in it for you, so go figure.
