NY and WA

to redo my questions. My business is in CA and i have business lic and reseller certification. I want a NY and WA reseller certificate? do i need a NY and WA business registration to have a reseller cert on those state. I don't any property or sales person on those state but only lease property. thanks

In regards to ans #3(steve). I hire an outside service to do my clients in NY and WA. They charge me sales tax because they say i do not have a resale certificate. I do not have nexus or ownership on the equipment because it is bought by financing company. I want to be relieve or somehow able to recuperate the sales tax from my vendor because i could not tax my clients out of state because i am not registered on their state.

I'm not sure about Washington, but NY does have a resale certificate for unregistered vendors. Just download the resale certificate for NY from their website. You will see a section there for unregistered vendors.

Are you leasing tangible personal property or real property in NY and WA? If you are, you must register with both states and collect sales tax on the payments. If you are leasing real property in either NY or WA, the fact that you are leasing real property means that you have nexus and you must collect sales tax on all of your sales that are subject to sales tax.

If you lease property, you are considered to have a "nexus" in that state. Leasing companies are the exception to the office or salesperson rule for establishing nexus.

You will have to register to do business an collect Washington and New York sales tax on the lease payments. Sales tax rates in these two states vary by location so it can get tricky.
