When your released from probation early off of a suspended execution of sentence...do you need to try to get your record expunged? would you still be considered as a felon? will potential employers see it? i was an aspiring lawyer and my friend asked me some of these questions but i don't know all the answers...is it even likely for my friend to released early from probation? take into consideration the charge wasn't horrible and the circumstances were just wierd...i kind of feel she got a messed up judgement. anyway that is not the point though what is done is done

Once her record is expunged she no longer holds the title felon. Yes she should look into getting it expunged, however in some states she may have to wait 5-8 years before they will allow her to. Depending on what her crime was, like if she has to make restitution, then once she is all paid up then they will most likely let her off her probation early. Unfortunately because of the Patriot Act, a low felony like a 5 or 4 which once employers would look over, now, they can't so she may have some trouble finding a job once off probation, but once her record is expunged no problem.

Once you are convicted of a Felony it is on your record for ever. Even after you finish your sentence / probation, it is always going to be there. Any employers that run a Criminal History Report or other back ground check will find it.

The process of of getting a charged expunged means to have it removed from your public view criminal record. Police and other government agencies will still be able to find the past conviction, though. So, they would NEVER get a law enforcement job.

Getting criminal charges expunged from your record is not an easy process. First you would have to see if your conviction even qualifies. Many do not.

You should start by contacting your state's Attorney Generals Office. They will tell you if by your state law the crime qualifies for consideration. You will then be instructed on what paper work must be filed.

You will need an Attorney to help you with the mounds of paper work and court appearances. This process will take months and maybe years and will cost you thousands of dollars.

It is not easy to do.

Expunged means deleted, like it never happened. Even if you are found not guilty, there is still a record of the arrest. When you get the charge expunged, the record disappears. The department that investigated the incident would still have a report, and the jail would still have a booking record, but no one would know to look for it as there is no public record of the offense.

It does not mean exoneration of what you did, all it means is that your crime is no long part of public record, but law enforcement agencies still have access to your FULL rap sheet.
