He should be manhandled by the people present there and hand over him to police. There is no need to conduct any court proceedings on him since it has a Public evidence. The Police can simply punish him for sweeping the roads atleast for 3 days in the public areas where he is residing . People should be civilised and feel responsible to do the same and the Government/courts shall make the law accordingly. Police and other Government authorities shall be loyal enough not to misuse the above law. Public should react violently if any government servant does the same.

certainly, i think of smoking is a detestable habit, i'm a former smoker, yet i've got faith completely that smoking (and all drugs) should not be constrained. Taxed heavily to pay for therapy expenditures yet no regulations different then high quality administration. i do in contrast to smelling smoke so I consume in eating place that are non-smoking or grant "actual" non-smoking components. yet I have not have been given any desire to create a slippery slope the place we legislate a guy or woman's habit because of the fact of "well-being" concerns.. The Nanny state mentality interior the U. S. must be stopped, smoking it only one small of occasion of the place it must be stopped.

No, it's not banned in all public places. I think it is a city by city decision. And on private property, such as restaurants, it is an owner by owner decision.
In my city in Texas, people can still smoke in public... and many restaurants still allow smoking in designated smoking areas.
So, around here, if you see someone smoking in public, either bum a cigarette from them and join them, or just keep walking.

Hey, I'd rather be a smoker than walk around sniffing everyone's clothes and being judgemental. The media has convinced your impressionable minds to fear and loathe smokers. Soon there will probably be an ad campaign on the telly saying "if you smoke, you are a rapist!" I wouldn't be at all surprised.

First off, I'm a smoker....and yes, obviously I'm stupid.
If a person is violating your clean air you can contact law enforcement to issue a citation.
Usually, when I smoke, find myself smoking by dumpsters and low traffic areas...which just simply shows how dangerous second hand smoke is.
I have tried to quit multiple times, but in the end, I end up succumbing to the addiction (wish me luck though, I'm on my 16th attempt to quit).

if they are smoking in an enclosed public place and you can identify the owner of that property politely advise him what the problem is and let him / her, deal with it, he/she is the one who has to pay substantial fine if he/she, does not prohibit this on his/her property.if of course identification of the owner is not possible then, remove yourself from the area, leave the arrogant person to continue their filthy habit.

Its banned in substantially enclosed public places.
If it's an open public place and there are no restrictions then there's not a lot you can do.

if it is banned, you could possibly get a ticket if a cop enforces it. Similar to driving without a seatbelt on in some states.
