Good question indeed.According to the rules of EN81part 1(european norms 81-rules for the elevators),there should be a capacity instruction in side a cabin by manufacturer.Another safety is that overload buzzer would alarm if the cabin is overloaded.so if the cabin would be overloaded the lift would not run.
If this system is not available in the elevators,the manufacturer or the company is criminally responsible.you just do complain to fire brigade.They have to solve the problems.

its the managements responsiblity to check an elevator's performance, and having said that, an elevator in a good working condition usually give an alarm if its overloaded.
so if something happens because of overloading, whoever passenger who took the risk and the people who let him/her come in should be one held responsible.

no person as no crime has been devoted. many times there is an overload detector which will sound and stop the raise working if it senses it relatively is overloaded. final on in might desire to be first one out until the raise is risk-free lower back.

allways blame the fat guy. they should know better.. in england if there are too many people in a car everyone in the car gets points on thier licence........ shared blame in that case..
