I think there have been cases where people who spit on someone else where charged with assault. Whether they were convicted or not, I don't know.
Let it go. It's not worth it. "Harmless"? Do you think he's not goint to react or retaliate in some way. Just let it go.

In my neck of the woods the official charge is Battery By Bodily Waste which is a Class D Felony punishable by 6 months to 3 years in prison.

Depends on where you live but spitting here is specifically not a crime. However, it would be considered disorderly conduct which is a misdemeanor. Spitting at police officers, firemen or other civil service members is a felony.

It could lead to a felony, any act of anger can lead down a wrong path. Some people have been stabbed for yelling at a car that drives by honking their horn. You best bet is to put this person on ignore.

depends on where--what the law is. COULD be seen as misdemeanor assault, or worse if you spit in their eye and cause damage. My suggestion: DON'T DO IT.
