If you owned the gun legally, you should be able to get it back (unless it is held as evidence).

POLICE JUST DO NOT TAKE HANDGUNS UNLESS:

YOU ARE A FELON IN POSSESSION OF IT?
YOU ARE ON PROBATION OR PAROLE?
YOU DID NOT HAVE A PERMIT TO CARRY THE WEAPON CONCEALED?
YOU DO NOT HAVE PAPERS SAYING YOU ARE THE OWNER OF SAID WEAPON?

WHY DID THEY TAKE THE WEAPON IN THE FIRST PLACE WOULD BE NICE TOO KNOW-NEED TO FILL IN THE BLANKS HERE?

Depends on what you did. Was it legal? Each state is different

If it wasn't used in a crime, you SHOULD be able to get it back, but don't bet on it.
