If I request copies of my joint tax returns from my husband, who I am seperated from, is he required to give them to me? He is also the tax preparer who did them. The tax prep office belongs to his Father, he is employed by his Dad.

He isn't, but you can get transcripts or copies from the IRS. See http://www.irs.gov/taxtopics/tc156.html

He should but if he won't you can order a free transcript from the IRS. Or you can order an actual copy of the return as filed with all supporting schedules for $39.00. That would probably be much cheaper than trying to get a lawyer to force the issue. Or, just ask at the tax prep office. A preparer must give you a copy on request and if it went through their system the staff will probably hand over a copy without question.

It all depends on if your husband was "working" for a client (which is you) or, if he was doing his own tax with you as a partner. Did you pay him? Were there an agency-client relationship? Did he act as a preparer or a husband?

In long story short, if he is not willing to give it to you volunteerly (and I am assuming that's why you are asking), it will take a law suit to force him to do it. What the law says is one thing (and even that is complicated due to the fact he was your husband and I am assuming you didn't pay him), and it is quite another to enforce the law.

I would request a copy from IRS. It's far easier and there is no way they will refuse.

Because you were smart and saved the evidence of threats on your phone which will correlate with the time and dates of you signing that paper under duress, I think you honestly can get away with NOT giving him your tax refund. I certainly would not give him a thing. You can tell a judge that he took your car and threatened to total it if you did not comply with his wishes and that will piss him off and he will do your husband no favors in the divorce settlement. Go ahead and get quotes for the damage he caused to the house. Take that amount and also subtract it from your $3800. figure. This guy has to pay the consequences for his actions. He black mailed you. That is illegal. You have proof. Secure that proof because you can use it against him. Your divorce may be settled by the April 15th, the deadline when you have your tax return dropped in the mail. So, hold off on sending it in, if you can. I would NOT give him your tax return.
