With all of the free consultations out there, it's probably best to ask an attorney this question. Laws vary from state to state and family law is the most complex, in my opinion. I wouldn't trust this question to just anyone on the Internet.

You can not take your child out of the state without letting him know because if he wants to be an ******** about it he can cause trouble for you and it could end up that you will never get to visit your child without a chaperon being with you at all times during visitation, and you don't want that. Be honest with your ex, play the game right or it will come back to bite you in the ***.
It is his child too and he has the right to know where his child is at all times and vice versa!

If you have sole custody, you should be able to. Check with your divorce lawyer to double check.
