No.......... a wheel chair is not a vehicle so therefore it is not a crime in and of it self.
But, if you are hammered and out on the street in a chair, you could get a pedestrian ticket for things like impeding traffic or crossing not at an intersection.
Or... you could be arrested for Drunk and Disorderly.

I'm nearly positive it's illegal to be drunk in public, unless in a bar. So yes, I guess it would be illegal to drive a wheel chair while drunk, but not because it's a moving violation.

I wouldn't think so. If you're in a wheel chair you must be disabled not not able to walk properly, so you need the wheelchair to get place to place even when under the influence. So that's like saying it's illegal for a person who is able walk, walk if the person it drunk.

Kind of depends on what kind of humor the cop is in. More than likely, if the cop was going to cite the drunk, it would be for Public Intoxication rather than DUI.
A lot depends on how your state's DUI law is written. Some laws state "motorized vehicle", so idiots on lawn mowers get nailed for DUI. Know of one guy who got nailed driving his battery powered golf cart while drunk. He beat the charge because battery powered wasn't "motorized" under that state's law.

Never did understand the logic. I was drunk, so I figured I shouldn't drive home. So I walked. Cop stopped me and wanted to know what I was doing out walking at 3am. I told him I was too drunk to drive home so I was walking. He arrested me for being drunk in public.
I should have driven.

well, i'm unsure about being drunk in a wheel chair, but drunk bike riding, and being drunk in public is illegal.

It is illegal to be drunk in public, period. Since using a wheelchair is a replacement for walking, it would fall under pedestrian law.

getting into drunk is illegal, if your wheeled, why you should drink. if your drunk don't used your wheel chair instead, sleep tight so that no accident will happen.

NO IN REALITY IT WOULD BE A PUI. A WHEEL CHAIR DRUNK CAN PULL OUT IN FRONT OF TRAFFIC AND GET KILLED AS CAN ANY PUI.(ARREST FOR OWN SAFETY AND PUBLICS)

Its not illegal to be drunk....its illegal to be drunk in public....but not period. However if you are drunk and wheeling around town....im sure they could get you for public intox. If you do it at home...whos gonna know?
