Ok. I was riding with a friend and we got pulled over by a ST in Texas (state trooper). Silly boy never told me that he had a SUSPENDED license. So I got a TICKET FOR LETTING SOMEONE DRIVE WITH A SUSPENDED license. Now I have to go to court in the morning. What should I do are say. Has anyone heard of this before. Please help...any one

You can only be found guilty of this charge if you have previous knowledge that his driving privileges are suspended, and you allow him to drive a vehicle owned by you. It is not your responsibility to check your friends drivers license.
Edit. If the vehicle was yours, and you didn't check, then you do have a problem. Your insurance wouldn't even be valid under the circumstances.

the best thing to do is be polite in all aspects first, let the judge do the talking he wants to do and then explain to him that you were under the impression your friend's license wasn't suspended. I'm hoping that he wasn't driving YOUR vehicle though, otherwise prepare to have the book thrown at you for not asking if their license was suspended before allowing your friend to drive. even if he didn't know it was suspended it's not your place to make sure he doesn't drive or to do a background check on him before he gets behind the wheel of a vehicle unless it's yours. and if your state's laws are the same as the ones I am from, if they're under 18 that someone 21 with a valid license is required to be in the vehicle, then it's your responsibility that they also have valid driving privilages.

I suspect the trooper was under the impression the car was yours. That is the only way the ticket would be justified. The trooper erred. When you go to court, take your friend's registration with you. Show that to the judge, the ticket should be dismissed.

If it was your car he was driving, then the ticket is justified and you might as well pay the fine. The law holds you responsible for who you let drive your vehicle.

Never heard of that one and I live in Texas. Sounds weird, but then we're a weird bunch down here I guess. LOL

I can see if it was YOUR car then it'd be your responsibility to make sure whoever was driving your car had a license.

Course, that's not so strange. I was car hunting last month and the dealer didn't ask me if I had a license, insurance or anything. Didn't even write down my name. Didn't go with us either. He just said they trust their customers and off we went. Surprised me to no end! I might go back after that car.

Oh, please! Someone tell me the statute covering THAT one. Since when is any passenger authorized to act in the capacity of a law enforcement officer and prevent someone from driving without a license?

So why is it that someone gets a ticket and must appear in court the following morning? For traffic violations, you have 12 days to pay the fine or arrange for a court date. And court dates are NOT the next morning.

I've never heard of that one before. I guess every state has it's own laws..... Just tell the judge you had no idea it was suspended and that you don't go checking license's before you go in cars with people. Even if they had one somehow, you wouldn't know by looking at it.

i never heard of that...but what i have heard of was that the police in t were assholes...

what i would do is go in there confused looking like u probably r...and just say..."sir...i never thought i had to investigate to see if his license was legit or not...shucks...he probably didnt know his license was suspended." hopefuly that will work...and ull get a warning.

yep-- ive heard of it .... go to court
tell them u didnt know ur friend had a suspended license.... cuff ur friend upside the head forDRIVING WITH A SUSPENDED LICENSE.....

next time ask who ur riding with if they have a license or not
