if you out rank him especially if you are an NCO (if you were you should know what actions to take) then you can get him for failure to obey a lawfull order violation of artile 92 of the UCMJ. but if he is not in your unit or chain of command what is the reason for you to be concerned with him. dont be one of those soldiers who get a big head and feels the need to mess with people just to mess with them. if your not disregard, but make sure you are in the right and for a valid reason before you pursue this any further. he could get you at the same time for interfering with his duties

Do you out rank him, and does he work for you? If the answer is yes, insubordination, failure to repair all apply.

J & C H:

willfully disobeying the lawful order of a superior commissioned officer

Orders requiring performance of military duties are presumed to be lawful when issued by superiors. Para. 14c(2)(a)(i), Part IV, Manual for Courts-Martial, United States (1995 ed.). However, "[t]he order must relate to [a] military duty, which includes all activities reasonably necessary to accomplish a military mission, or safeguard or promote the morale, discipline, and usefulness of members of a command and directly connected with the maintenance of good order in the service."

Now as the asker did not state his rank, I'm afraid I have to assume he does out rank this dweeb, and if the suspect soldier is conducting an unsafe act and told to correct his actions and refuses, this would in fact apply.

Now assuming that you, as a First Shirt approached a troop not in your chain of command who was committing an unsafe act, and you instructed him to get his head out of his rectal area, and he responded to you; "got a problem? Call my supervisor", just how high do you suppose he would get jacked up?

Would have responded to you directly, but as most trolls, you have no contact information.

Sad to see that it has become common to see questions about Military Discipline being posted on Y/A!!

Are the current generation of military personnel not receiving ANY instruction in how to carry out their job??

This is really a sad state of affairs "IF" the poster is really in the military.

Taller... do you even know what failure to repair is? Obviously not.
Why are you asking this question on here. Do you have a First Sgt. or a commander. I bet they would know more then anyone on here. Besides, I hope you are not correcting his sentence structures or typing. Yours is horrible. I bet you are a little kid trying to get attention.
Out of your chain of command? My years (21, 6 as First Sgt) tell me to have you mind your own business. I don't think you are in any position to correct others.

If you're an officer and he's an enlisted man, he's in deep trouble. You could have him on charges in no time. If you are an NCO, then you write your report, hand ot to your officer in charge and get the ball rolling . Get this wise a-- back in line.

If you are not a hardstripe E4 or above back off. If you are and are asking here you should not be beyond Spec 4. Period, end of story.

If you are an Officer you are a sad example.

Do you out rank him? If not get a uniform that does, put it on, ream his butt, then take it off and get your own uniform back on and if he reports you saying you had a uniform on that out-ranked him and chewed his butt, tell them he is just another of the mentally ill individual's the military is trying to weed out before they commit any crimes against the UCMJ! I always kept a Four Star Generals uniform under my bunk for this exact purpose! I reamed so many people out...I lost my voice at times! For those of you saying use violence as a means, when I had the General's uniform on I had people put before a firing-squad!
