ok im being evicted because a guy called the cops cuz my musice was "to loud" later that night we got into a fight is there anyway i can fight the eviction and win? thanx

Nope. Your being evicted for fighting on the premises. Nothing you can do to force them to allow that behavior.

You are clearly not very well educated so I recommend working on that first. Why should you fight an eviction? Do you own the property or does the landlord? The landlord does and he/she should have the right to give you the boot if they are not pleased with your behavior, how well you care for the bldg or if you don't pay your rent either on time or at all. I think the laws have gone too far in covering tenents. I used to own a duplex that I rented out and I could NOT get rid of a non paying tenent even though I could barely pay the mortgage. It isn't your place!!!
For future reference, show some respect for those around you. If you are renting, you are clearly not out in the country on 20-30 acres with no houses for a half mile or so. Your neighbors are close and though you may wish to listen to your music loud, it is extremely rude when you have close neighbors. Grow up, get an education and learn how to respect others instead of always thinking it's all about you.

Absolutely! Tenants almost have more rights than there landlords these days. It of course depends on your situation, the state you live in etc. But, it general, if you are residing in an apartment, and not a room within the landlord's house, you may triumph yet.

The eviction process can be long and ardeuous for the landlord and it is imperative that you force him to abide by every rule in your jurisdiction - including service of process and how you received notice of the impending eviction. The fact that you and the annoyed neighbor later had an altercation does not serve to help you. However, it doesn't automatically cause you to lose your residence either.

My suggesion is to do some research on Landlord Tenant law in your county and state - educate yourself as to the process and then never miss a court date! I'm betting you have better than a 75% chance of victory! Good luck!
