What happens if my husband is not a legal resident and we are having a baby?

Well, the baby will be a US citizen. What you should do is hire an immigration attorney and figure out the best way to get your husband's immigration status changed for the better.

Get ready to be separated from him for at least 9 months.With the new and "improved" immigration laws,he will have to return to his country of origin and wait for a visa to return to the USA. You have to submit an I-130,fill out an affidavit of support,and,pay for him to get his visa.

2. Are you a US citizen?
3. Where is he from?

He'll need to go back to his country of origin.
You'll need to file for a visa for him, and prove you make enough $$ on your own to sponsor him.

It can take 14 months or maybe more to get him up here.

If he's an illegal alien, who came here illegally, there's nothing you can do for him until he returns to the country where he belongs.

The good news is that your baby will be an American citizen.

you can try to get him legal yourself but good luck Been there tried that now running scared
