no I am not pregnant I was just having a discussion with a friend and we just couldn't agree on the answer so L decided to post the question

The question was brought up by me to happy hurmet. I have a friend who was pregnant and was smoking pot. She quite 35 days before her due date and told me that in TX they now test you and the baby. If there are any present drugs in your system that CPS would be notified immediately. I agree no one should use drugs while pregnant especially hard substances such as crack, cocaine and so forth but my question is why does "Big Brother" feel it is their job to do so and are able too? I have a problem with our government having the right to test its' citizens without our approval? I am not an advocate of drug abuse so please don't mistake the point. Call me Liberal or whatever!

Well in most hospitals if the mom comes in acting high like major paranoia or something then they will run tests to make sure what is going on because complications can bring on problems too then if the tests come back abnormal they may do a toxscreen and if that is positive for illegal drugs they would probably call CPS but no they do not do routine drug testing when you are in labor...most woman go into the hospital in labor and so much pain they wouldn't be able to get the tests run and that isn't their top priority at that moment. Now if a baby is born and shows sign of drug dependency then they will run tests and call CPS if the tests are positive for illegal drugs.

Wow don't you just love how people assume b/c you are asking a question then you must be getting ready to deliver and you are high.

Anyway to answer the question I don't recall being tested when I was in labour. I have heard that they test the baby if the baby appears to be going through withdrawls and that they do testing if the mother is on state insurance. Apparently for some reason they do test the mother/child, if it is dirty then CPS does start investagation and so on, a friend of my husbands delivered twins that were suffereing from oxy withdrawls and they had to go to the grandparents till the parents were investgated.

Rightfully they should. If you test positive for drugs while in labor that means you've DRUGGED your baby! And THAT IS CHILD ABUSE!

Your baby may have to go through withdrawl and that is medically tricky in a newborn.

Yes, CPS should be informed if a new mother has been using drugs during pregnancy and has potentially given birth to an addicted or damaged baby.

You have no rights to privacy when you abuse your baby before birth. What's stopping you from continuing the abuse after the child is born? You're abusing yourself and neglecting your child while you are under the influence.

I gave birth in 2 different states and didn't get drug tested either time.
I do know this girl who gave birth to a deformed baby who was showing signs of withdrawal and they tested the baby and he came back pos. for a few different things and they put the baby into foster care, she is now clean and fighting for her baby (18 months old).
With the drugs in todays world and alot of pregnant women still using after getting pregnant, they should start testing for drugs in the system when they get pregnant, while pregnant and after pregnancy. It would save a lot of heartache of seeing those babies going through hell.

Not true. They dont do drug test on people, they have to have reason to do a drug test. If the judge order on or for other reasons. The answer to that question is NO.

I believe that is only when there is a past history of child abuse or drug abuse. I would not expect a drug test taken when I am in labour when I know that it is necessary and would not appreciate anyone putting me in a category of a person needing a drug test.

No, they drug test the baby. If your baby tests positive for any drug, they will put you under investigation, and the baby will be put into social services until they determine whether you are a fit parent. At least thats what happens where I live...

no they drug test if the baby seems to be going through with drawl symptoms if the baby is drug positive they call cps they test the baby not the mother :(

I don't recall being drug tested! I would assume that if the baby showed symptoms of withdrawl they would do it, but i'm not certain drug testing is common practice.
