In fact the best way is your husband to adopt your daughter and give her his name. But also depends on your daughter biological father, he must be not taking care of her legally, or deceased. If he is living he must agree with the adoption.
In other words, you can not "skip" him.

Well most states will require you to have formal proceedings and that includes terminating the real fathers parental rights. Most states will require a DNA test to put a father on the birth certificate if it wasn't done at the time of birth. Best bet is to ask state specific questions or to contact a family law attorney in your area.

you hae to have the father sign off his rights or something i think i am not too sure. but anyhow the best thing is to get a lawyer and find out what you have to do. it can be done if he adopts the child. its funny how one does't want a kid till they know there is problems for you all. that is what sometimes happens but no child support? is there no name on the birth certificate that could help just find out and get moving it could happen. take care.

You would need to get the father to sign over all his parental rights to the girl and he would need to give his consent to a name change. If he doesn't do either of these things then you can't adopt your child.

The father would have to adopt her. I have gone thourgh this experience because i was the child adopted by the father but my mom was my real mother. So first hand experience.

No, she cannot just change her name on her own. You would have to go thru an adoption procedure first.
