My daycare provides afterschool pick up for my son from his elementary school to the center. He is 7 yrs old and he is being transported in an 8 passenger chevy van of some sort. They have 6 children with the one adult driver. Since all the children are young/elem. school age, they are all in booster seats. The problem is that there is not room enough for each child to have a booster b/c the width of the seats won't accomodate 3 across. How can I find out what New York states requires with regard to seat belted children in a daycare van? The daycare is now asking me to write a note of permission for them to transport my son in the third row of the van with only a lap belt. He would be between two booster seats and the seat in front of him is high - similar to a school bus. What are your thoughts on this? Where could I find out if this is even legal for them to do? I know school buses only have lap belts but don't they have different regs? Thanks for your help.

By the way, they chose my son b/c he is the tallest and oldest kid. I think he's average - about 57 lbs and about 4'6".

Don't sign the slip. Have them ask someone else's parent. Tell them you don't feel comfortable with it. And 3 will fit across if they are the cosco seats from Walmart--those are narrower than the Graco ones everyone seems to have.
