Can you file seperately? Or do you still need to keep filing jointly? Reason I'm asking is because my husband owes back child support, and they will start taking it out of our tax returns, so I was wondering if I can file seperately?

Each year is separate, so yes you can file separately even if you filed married in the past. You can't amend a previous year's return from joint to separate though.

You can file jointly but file an injured spouse form with your return, and still get your share of the refund and only his share will be taken for his back child support. It's another alternative to filing separately.

You can change from year to year. Also, if you file jointly, and they take the return, they will send a letter first. Then you can file an injured spouse form and they will give you back your portion of the return like you had filed seperately. This may slow down the child support folks getting his portion.

You can choose filing Jointly or Separately each year. Separate returns can be amended to file jointly. Once you have filed jointly for a given tax year, you can't change to separate for that tax year.

You can file separately for one year after filing jointly for an earlier year. However, you cannot amend the early return from joint to separate.

You can determine your filing status each year. Just because you filed jointly one year, you do not have to continue.

Check it both ways and file what is most advantageous for you.
