A few weeks ago I was on the high way and this woman pulled in front of me and slammed her brakes, she seemed drucnk I flicked her off and got away from her by goign in to the shoulder then took off. She sees a cop a few miels down she stops and claims that I threw something at her car and gives him my plate #'s. He comes to my house and when he doesnt find me he calls me and asks me what happened, I didnt know what he was talking about then I remembered her and I told him what had happened, he says she claims I threw soemthing I told him I do not know what he is talking about (he says there is no damage, no injury, no objects retrieved; no evidence) but he insists I coem to the station and give a sigend statement, I ignore him for a few weeks and then he called me a few days ago and said that If I dont come he will get a warrant for my arrest... oh and I talked to him over the phoen the day of the incident and told him the truth and denied that throwing an object b.s. but either way since he didnt read me my rights I guess everything I said to him is safe liek he cant use it against me right? please help, give detailed answeres, my future is at stake here it is a felony in my state and this cop just wants to screw me, he didnt say it but thats how I feel

ok some of you asked some questions here are the answeres:

* I was nice to the cop the whole time and he has tried to be nice for the most part too

* I have a clear criminal record, 6 years in the military but my driving record is pretty crapppy (speeding, and stupid stuff but never anythign like this)

* You are right it seems like he should have soemthign better to do with his tiem and thats what makes me worried, why does he keep calling why is this so important to him??

You ignored him when he asked you to come in and sign a statement, now you are wondering why he is coming after you?

Duh! He got a complaint and tried to follow up on it, you ignored it and now you made a mess for yourself. My best advice would stop being a jerk, go to the station and fill out a statement.

As police officers, we get this sort of thing all the time. The sort of person who is going to flag us down and complain about something "thrown" at their car. Is the sort that is going to call us every day and ask about the status of the case. It is especially annoying for small departments, since they will call the chief, mayor, councilmen ect and complain about you not doing anything. So the officer is probably just as annoyed by this as you. Because I would bet money that lady is still bugging him.

Even if he charges you with a crime, no evidence, no injuries, ect, it's not going to be a felony.

BTW, phone statements are not covered by miranda (or "your rights"). Anything you say over the phone to police can be used against you and they do not have to tell your rights. The only time you need to be read your rights is when you are in police custody "free to leave" and being questioned. I get people to confess all the time over the phone, it is a great thing.

What all you people don't understand is that cops are LAW ENFORCEMENT not JUDGES. If one party says that something happened, and wants a report filed then it has to be, even if the cop knows that it is BS. The cop probably believes you, but he still has to do his job, which at this point is to question you. The cop is not trying to screw you, that's silly. The woman is trying to screw you. If there is no proof and you didn't do it then you have nothing to worry about. Humor the cop for a little bit and give him what he needs so you can get what you need. I think he deserves that much since he risks his life everyday for you. Lay off the people that protect you. By ignoring him and not complying with his requests you are breaking the law by causing an obstruction to justice. It doesn't sound like you have much choice, just go and get it over with.

Lets look at this objectively:

Woman tells cop you threw something at her car. Cop takes her statement.

Cop inspects woman's car - sees no damage. IE- no proof that something was thrown at car.

Cop contacts you to get your version and you tell him you did not throw anything at woman's car - but you did give her the 1 finger salute because she brake checked you. (So now she has reason to be mad/offended at you).

Cop considers this and fact that there is no damage to woman's car.......whose story has more credibility here?

I guarantee the woman has made a written statement so now the Cop needs you to make a written statement too with your version.

Then you have word vs word and the woman has no proof that you threw anything - she can't produce the object and has no damage to her car. No independent witnesses.

By avoiding the cop you are ticking him off and that is a completely separate matter.

Just get your fanny to the station- write up your statement and let the man close out that investigation and move onto more important stuff.

By not doing the right thing and admitting to what you have done, your screwing yourself. I will tell you, from what you have described, that your what society calls a very hostile driver. If she offended you , in anywhich way, why didn't you stick around and defend yourself ? Somehow your not telling the entire truth. Must have been serious or the Officer would not tell you about a warrant. Go and do the right thing. You need to go to the Police Station now.

cory knows what he is talking about. You didn't admit anything and he hasn't come after you with a warrant. Furthermore, you are not required to go into the station to sign anything simply because he says you have to. I would go see a lawyer and tell him you story. Most lawyers won't charge you for a consultation. Perhaps a simple phone call or letter, which may cost you $25, will get the police officer to understand that you have the upper hand and that it needs to end.

I would have to answer this question with several other questions. Have you been a constant source of earlier complaints? Were you rude and belligerent with the officer when he called? Where in the world do police officers have time to even follow up on such trivial matters as you are describing. There is either far more to the story or this lady was someone of great importance to him.

Cops can use deception (lying). Your statements are acceptable as you don't need to have your rights read on a telephone interview. Miranda warnings are only necessary when someone is in custody (handcuffs, in back of squad car, etc) and officer asks incriminating questions. Sounds like he may have been trying to get you to say you didn't throw anything out the window but did something else incriminating. If there is no evidence and no admission by you, you should have nothing to worry about.

if there is no proof its just he said she said, and the cop cant arrest you for 'allegedly' throwing an 'alleged' object at the woman. (make sure you use that word alot so you dont accidently admit to anything you didnt do.) remember its innocent until proven guilty, but i think he can ask you to come and sign a statement tho. i would suggest you just go down and sign whatever they ask you to- but read it first! make sure you are DENYING the charges. that way everything is on record, the cop has done his job and it will just be in the past. if you do fail to show up to sign that tho, i dont think they can really arrest you, and like charge you for anything, just fine you maybe. it would probably just be best to go get it taken care of. there is loyalty among cops too, so pissing one cop off wont make the rest of your life any easier. just suck up, kiss up, deny everything, and it should all blow over quickly. just to be on the safe side tho- ask for copies of EVERYthing you sign. just incase you do need to get a lawyer involved.

Hello, this cop isn't out to screw you but he has a report that was done and he has to follow up on it other wise his job is in jeopardy. Are you with me? The complaint was made first by the complaint now you are given an chance to do your part, its a simple matter and you are making it worse. Tell him in an informal meeting then he will have completed the report..that's all there is to it.

in order to get a warrant that cop has to go to a magistrate and provide "probable cause" that you did what he is getting the arrest warrant for. A judge or magistrate will look at that and basically be like "wtf, get out of here". IF everything you say is how it actually is. If he calls again tell him to get the "warrant" and he will be hearing from your lawyer shortly. Have a lawyer contact him and scare him straight, you will be fine!
